Under Arkansas law (HB 1503), an ADU is defined as an independently accessed unit with its own cooking, sleeping, and sanitation facilities. No. Arkansas HB 1503 specifically prohibits cities from requiring additional parking spaces for an ADU or charging fees in lieu of parking. The law also prohibits owner-occupancy requirements — meaning neither you nor your tenant is required to live in the primary home or the ADU. There are also no requirements for a familial or employment relationship between occupants of the main home and the ADU.
